Brittanie Cecil died Monday night, two days after she was hurt at the game between the Columbus Blue Jackets and Calgary Flames, Children's Hospital said. It was believed to be the first death of a fan hit by a puck at an NHL game. "Our fans mean the world to us," said Doug MacLean, Blue Jackets general manager. "This loss has profound effect on the entire Blue Jackets family." The shot by Espen Knutsen of Columbus flew over the high glass at the west end of the rink, glanced off another spectator and struck the girl in the head, witnesses said. After being hit, the girl was seen standing with a jacket being held to her head. Teams warn spectators over the public-address system about pucks flying into the crowd. They also place warnings on scoreboards and on the back of each ticket. NHL spokesman Frank Brown said Tuesday he could not recall any other fan killed by a puck. He said one NHL player died from injuries in a game. Bill Masterton died Jan. 15, 1968, days after falling. Although rare, spectators have been killed and seriously injured at hockey games, particularly in the low minor leagues and the amateur ranks where the glass is not as high around the rink. A 21-year-old Canadian man died on March 5, 2000, after being struck by a shot that flew into the crowd during a South East Manitoba Hockey League game between Altona and Carman a week earlier. A 9-year-old girl died in 1979 after being hit in the forehead during another Canadian game. | O&A Board Veteran Registered: Feb. 01 | I don't think you can sue the NHL, the teams, or the arena, just by buying your ticket you are agreeing to a disclaimer and assuming responsibility. But I would imagine that they will be compensated without lawsuit. I believe in the Faith... that can save me. I believe in the hope and I pray... You should expect to see a lawsuit in coming days, I'm taking a sports law class and we were taught the disclaimers on the back of tix were absolutely worthless. what will most likely happen will be the team and facility being sued. I'll update this if we discuss this issue in class more because of this unfortunate event.  | ||||

| Psychopath Registered: Oct. 00 | the team will definitely say they assumed the risk..because she 1) had knowledge of the risk 2) voluntarily proceeded in the face of that risk and 3) risk must be inherent to the activity....BUT the assumption of risk doctrine has been wiped out in many states and you can not defend by those means(not sure about ohio). Her side will argue that the team had a duty to provide a safe environment to watch the sport, breached that duty, and that was the cause of the harm- could be as simple as saying hey maybe the boards should be a foot higher to try to stop pucks...I'm by no means agreeing with this at all but we do live in a very litigious society and the law is readily available to people who want to collect. Also, again I'll repeat the disclaimer really does mean nothing because in order for a waiver to be valid it needs to be signed..plus she was a minor so a waiver wouldn't be upheld anyway because she has the ability to void it. (also i'm not a law student, i'm a sports management student and for the record i hate LAW) | ||||

I'm pretty sure Jimbo is correct about disclaimers; I know if you go into a restaurant, and they check coats, they might have a sign that says that they are not responsible, but they ARE responsible. In this case they will argue that the BlueJackets didn't do enough to protect fans. Even if they are able to win a case, NHL will settle out of court no doubt.  | ||||
