they didnt take my car because i only blew a .07 , i didnt fully understand my rights so at the time i thought $300 and the class seemed like a good deal. after reviewing the law more closely, it seems like i should have had all charges dropped.

does anyone know how i would go about filing a motion to vacate a guilty plea in the criminal court of new york city?

I believe .08 (.8?) is over the legal limit here also.

Anything below that, however, is simply a 12 hour suspension.

Last I "heard", a 12 hour suspension had no fine connected. Though, they do tow your car, from wherever you got snagged.

i got myself a lawyer. for $500 he said he can get them to dismiss all charges. i guess its a good deal considering the fine is $300 and i wont have to take the class and won't have any points.

You don't want a DUI or DWI conviction then the Insurance Company's jack the rates sky high forever (ten years).

Always cheaper to pay the lawyer then the Insurance Company IMO, the lesser of two evils.
