Quite amatuerish
First of all, driving while using a cell phone is no more dangerous than putting on make-up or reading the newspaper (both of which I have seen people doing). The bottom line, the law is ridiculous. There is already a statute in probably every state called "Careless Driving". To me, it doesn't matter what you are doing when you are driving your car as long as you are using due care and caution while driving. Hell, eating is probably the most dangerous thing you can do while driving and people do that every day.
