There's too much monetary pressure to build to allow sentimentality to delay this for too long. All the concepts so far have preserved the footprints of the towers as park/memorial space and that's great. But the rest will get developed again.
NYC depends too heavily on that district for it's economy. Silverman's lawyers will be able to apply too much pressure under the lease agreement. Not to mention that the construction industry has been slow to dead since 9/11 and this construction project would have them all rolling in work for years. So, you'll have every trade union in the city pushing for it. And all the downtown businesses that have been suffering.
