I agree with Teenweek...be happy its just $88 and get on with it. Its not the justice system...its just being a bit careless.

Insurance company's are for the most part filled with assholes who look for ways to screw you (the consumer) anyway, shape or form. By letting you take the 50% fault they will now have another reason to charge you more money for premiums.
It's all about the money to them. None for you, more for them. With such minor damage done. I would not have reported it and would have worked out something with the guy. Granted if nobody was around I might have been tempted to drive off. Calling the cops usually proves to be a waste of time and energy. The spooks come out at night.

It doesn't take much care to avoid hitting shit when you're backing up. I could understand if the car was moving, but it was PARKED. You hit a fucking car that wasn't moving, and you're looking for excuses as to how it's not your fault... TSK TSK!!! The justice system works just fine, it's assholes like you that can't take responisibility for their own actions in whom I have lost all faith.

It is still your fault you hit him. Nothing about your story makes sense. We all know the other driver was wrong and should have gotten a ticket and he is an Asshole for leaving his kid in the car, but you should have not hit him. None of that matters. You were not paying attention and you hit him. That is all the insurance company needs to know. People park in fire lanes all the time, while leaving somone in the car, but I don't see other cars plowing into them.
