I think the victim (if still living) and the victim's family (if the victim had passed) should have a say on the punishment of the accused. Anything up to and including a personal touch with the same crime perpatrated to the perpatrator. That would also hold true with the convers; if said victim forgave and forgot, the perp can walk.
