Michael Emmanuel Barima was stabbed on Wednesday with a pointed object that pierced his jugular vein, medical examiners said. Police recovered a green pen that fit the description of the pointed object. Police charged the boys on the testimony of the victim's sister, Abigail Ghunney, after determining she was too young and had too little time to fabricate her story, local media reported. "The key witness is five years old, it's her word against the two boys. Her age supported her story, her innocence," police commander Joseph Reznick told the New York Times. New York state law allows children as young as seven to be charged with crimes as juvenile delinquents and tried before a judge. If convicted, the boys could be sentenced to up to 18 months in a limited secure facility. And these little animals can only be locked up for 18 months? Fucking ponderous..... | Psychopath Registered: Sep. 01 | As a kid at a friends house, we were throwing pencils at each other and one of the pencils he threw, a recently sharpened one, pierced a vein in my nose. Nothing big, just toss my head back for 15 minutes and I was fine, nary a scar. But a couple inches left or a couple inches right and I may have lost an eye. A few inches lower and I could have been the kid in that article, you never know. Bottom line is kids get into so much potential danger that it sucks when something like this happens. Maybe it was a freak accident but someone has to be responsible and it should be the parents.  | ||||

In order for these kids to be convicted of murder, it needs to be proven that they not only took this child's life, but that they intended to do so (mens rea is the technical term but I don't know if I spelled it right). It could have been an unintentional event. On the other hand, their parents have a responsibility to watch these children at all times and protect them from being in these possibly harmful situations as well as creating harmful situations for others. Where were the parents when all this was happening? They should be held responsible for their children.... why do I say I'm fine when it's obvious I'm not? why's it so hard to tell you what I want? why can't you just read my mind? | ||||

| O&A Board Regular Registered: Oct. 00 | I read that story in a paper. I don't think the parents had anything to do with it cuz it said the children bullied the dead kid a lot before this happened. If that's true, I think its a case of bad seeds doing horrible shit. Bad parenting can only make a kid so bad before you realize the kid didn't have a chance from the start. That's my opinion.
