Calling Napster's efforts to block copyrighted works from its online music-swapping service "disgraceful," a federal judge said yesterday she may consider shutting down the site.

U.S. District Judge Marilyn Hall Patel, who is presiding over the copyright infringement case brought by the recording industry, stopped short of putting her thoughts into action and said a court-appointed expert will review claims that Napster is failing to remove copyrighted material from its service as ordered to do by the court.

Napster has nearly 70 million users.

The courtroom drama illustrated how difficult it is to remove copyrighted works from the Internet site while allowing non-copyrighted materials to remain. "You created this monster — you fix it," Patel said in a terse tone from the bench.

An industry lawyer said that of 5,000 songs the record labels asked to be removed, 84% are still being downloaded free on the Napster site.
